These Terms and Services ("Terms") govern your access to and use of www.elpacco.com (the "Website") and any enquiries, quote requests, sample requests, or orders you make with El Pacco ("El Pacco," "we," "us," or "our"). By accessing the Website or submitting a request through it, you agree to these Terms.

If you do not agree to these Terms, please do not use the Website.

El Pacco is a Ukrainian manufacturer of gift packaging products — including paper gift bags, cotton/twill/jute tote bags, greeting cards, and festive packaging — operating since 2015 and based in Kyiv, Ukraine.

2. Use of the Website

You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of, the Website by any third party. You must not:

4. Product Information

We make reasonable efforts to ensure that product descriptions, images, specifications, and pricing information on the Website are accurate. However:

  • Product images (including colours and finishes) may vary slightly from actual products due to photography, screen display, or production batch
  • Specifications, minimum order quantities, and pricing are subject to change and will be confirmed in a formal quotation before any order is placed
  • Nothing on the Website constitutes a binding offer; it is an invitation for you to submit an enquiry or request a quote

5. Quotes, Orders, and Custom Products

  • Submitting a form on the Website (e.g., "Request Quotes and Samples") is an enquiry, not a binding order. A binding agreement is formed only once we issue a formal quotation or invoice and you confirm your order in writing.
  • Minimum order quantity is one europallet (120×80×160 cm), unless otherwise agreed.
  • Volume discounts, where applicable, are subject to the terms communicated at the time of quotation.
  • For custom design or private label products, you are responsible for ensuring that any artwork, trademarks, or branding you provide to us does not infringe the rights of any third party. You grant us a licence to use such materials solely for the purpose of producing your order.
  • Standard production lead time is minimum 2 weeks from order confirmation, depending on volume and product type, and will be confirmed before production begins. Lead times are estimates and not guaranteed delivery dates unless expressly agreed in writing.

6. Delivery

We offer the following delivery terms, as agreed at the time of order:

  • FCA Kyiv — you arrange collection from our warehouse in Kyiv, Ukraine
  • DPU — we arrange delivery to your specified destination

Risk and costs pass in accordance with the applicable Incoterms as agreed in your order confirmation. Delivery timelines communicated by us are estimates and may be affected by factors outside our control, including customs clearance and logistics disruptions.

7. Samples

Product samples may be requested via the contact form or WhatsApp and are shipped from Kyiv. Sample terms (cost, shipping, and any applicable charges) will be confirmed with you directly before dispatch.

8. Payment

Payment terms, currency, and methods will be set out in your formal quotation or invoice. Any deposit or payment schedule agreed for a specific order forms part of that order's terms and is not governed further by this general policy.

9. Warranties and Limitation of Liability

We warrant that our products are manufactured to meet applicable material and environmental standards, and quality documentation is available on request.

To the fullest extent permitted by law:

  • The Website and its content are provided "as is" without warranties of any kind, express or implied
  • El Pacco is not liable for any indirect, incidental, or consequential damages arising from your use of the Website
  • Our liability for any order is limited to the value of that specific order, except where liability cannot be limited or excluded by law

Nothing in these Terms limits any statutory rights you may have that cannot be excluded under applicable law.

10. Confidentiality

Any non-public business information, artwork, or specifications shared between you and El Pacco in connection with an enquiry or order will be treated as confidential and used only for the purpose of evaluating or fulfilling that enquiry or order.

11. Third-Party Links

The Website may link to third-party sites (such as LinkedIn). We are not responsible for the content, policies, or practices of any third-party website.

12. Privacy

13. Governing Law and Disputes

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles, unless otherwise agreed in writing for a specific commercial contract (for example, where parties agree to apply Incoterms or a different governing law for cross-border orders). Any disputes shall first be addressed through good-faith negotiation between the parties before pursuing formal proceedings.

We may update these Terms from time to time. Changes will be posted on this page with a revised "Last updated" date. Continued use of the Website after changes are posted constitutes acceptance of the updated Terms. Terms applicable to a specific order are those in effect at the time that order is confirmed.
